1. Who we are
Flush Finder ("the Service", "we", "us") is operated by the Flush Finder team("Seller"). By using the Service you are entering into an agreement with the Seller.
2. Acceptance
By accessing or continuing to use Flush Finder you agree to be bound by these Terms. If you do not agree, do not use the Service.
3. The Service
Flush Finder is a crowdsourced platform for finding, rating, and reviewing public bathrooms. Optional voluntary tips support the Service. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, fraud, or spam;
- Infringe the intellectual property or privacy rights of others;
- Upload malware, attempt to probe, scan, or interfere with the security of the Service, or scrape data in violation of these Terms;
- Post content that is illegal, harassing, hateful, defamatory, or harmful.
5. Your account and content
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. You grant us a limited, non-exclusive license to host and display content you submit solely for the purpose of operating the Service.
6. Intellectual property
The Service, including its software, design, and branding, is owned by the Seller and protected by applicable intellectual property laws. No rights are granted to you except the limited right to use the Service in accordance with these Terms.
7. Payments and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refunds are governed by Paddle's Checkout Buyer Terms. See also our Refund Policy.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Ratings and reviews reflect the opinions of users and not the Seller.
9. Limitation of liability
To the maximum extent permitted by law, the Seller's aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill.
10. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated violations of our policies.
11. Changes
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws applicable in the Seller's jurisdiction. Disputes will be resolved in the competent courts of that jurisdiction.
